A newly proposed law in Oklahoma would allow property owners to shoot down drones flying over their land, reports Ars Technica.
However, the law would conflict with federal legislation that says it’s illegal to shoot at aircraft. The federal law includes drones in its definition of “aircraft.”
The bill seems to have been proposed in response to several nationwide incidents where property owners shot down drones they believed to be flying over their property.
Federal law does not currently recognize the concept of aerial trespass. But Oklahoma is hoping to change that with its drone law. Some legal scholars have already pondered whether trespassing laws should be changed to factor in drone technology.
However, there’s another potential hang-up for the proposed law: the Federal Aviation Administration claims jurisdiction over all airspace, period.
