Despite the U.S. Supreme Court’s gay marriage ruling last year, Texas Republicans are not yet ready to give up the fight, reports The Austin American-Statesman.
GOP activists in the state have now launched legal briefs and an email campaign targeting individual justices on the all-Republican Texas Supreme Court.
Their aim is to create a precedent by abolishing benefits the city of Houston provides to married same-sex couples. In the view of many conservative legislators in the Lone Star State, the Houston case provides a good opportunity to limit the scope of the U.S. Supreme Court ruling.
But there’s a major hitch: By an eight to one vote, the Texas high court has already upheld a lower court’s ruling that let the benefits stand. So, the efforts of gay-marriage opponents will require eight of the Texas Supreme Court’s justices to go back on their own ruling.
