Texas and Kansas stand to be repaid over $400 million in lost health care funds if a late-August Federal ruling stands.
As The Austin American-Statesman reports, a federal court in North Texas has ruled that the federal government improperly charged Texas, Kansas, and a few other states millions of dollars in Medicaid fees, in an effort to help fund the Affordable Care Act.
The finding comes after Texas Attorney General Ken Paxton filed a lawsuit to recover money the federal government collected from the Health Insurance Providers Fee.
Texas will be repaid over $300 million, while Kansas stands to receive over $140 million.
Paxton said in a statement, that his office is “proud to return this illegally collected money to the people of Texas,” adding, “Obamacare is unconstitutional, plain and simple.”
However, the deal isn’t done yet. A U.S. Justice Department spokesman told the American-Statesman that his agency is reviewing the decision.
