Paxton Asks Court To Uphold Constitutionality Of State Law On Disposal Of Fetal Remains

Texas Attorney General Ken Paxton has asked a federal appeals court to uphold the constitutionality of a state law on the disposal of fetal remains.

Paxton asked the Fifth Circuit Court of Appeals Monday to review and reverse a lower court’s decision which blocked Texas from carrying out a part of Senate Bill 8 requiring the burial or cremation of remains from abortions and miscarriages.

U.S. District Judge David Ezra had previously ruled that the law was unconstitutional because it created “substantial obstacles” and undue burdens for women, doctors, and abortion clinics.

Paxton argues that the law doesn’t impose an obstacle to a woman’s right to an abortion.
